Electronic submission of files requires the resolution of photos to be 1050x1500 pixels (300dpi) or greater. Submitted files that are greater than 5M in size should be submitted via yousendit.com, a free file transfer system for sending larger files over the Internet, or hard copies can be printed and mailed directly to A Personal Expression (See mailing address above).

Orders can also be placed via telephone and photos submitted separately by mail or email.

ELECTRONIC PROOFS
Our goal at A PERSONAL EXPRESSION is to provide our customers with superior quality and exceptional design service. Although we are confident you will be happy with our designed products, electronic proofs of the design can be requested. One proof is complimentary with each order and any subsequent proofs resulting from customer revisions will incur an additional charge per proof (Photo Card Orders = $4.99 and Framed Invitation Collages = $7.99).

CHANGES AND CANCELLATIONS
Since our products are highly personalized, you may receive an approval image via email or mail, upon request. Once personalized orders are placed and payment is received you will have 30 minutes to contact us with changes or cancellations (service@apexpression.com).

A Personal Expression does not review any submission for spelling, grammar, or any other errors. However, if we spot something that we feel looks to be a mistake our design will contact you to verify a correction.  We do not guarantee that errors will be caught prior to production. It is the sole responsibility of the customer to ensure that all information is correct. The designs will be produced/printed as they appear in the approval proof if one has been requested.

We currently accept PayPal, major credit cards, personal check, or money order made payable to A PERSONAL
EXPRESSION. Please allow for 7 to 10 days for checks to clear. A $20 fee will be assessed for any returned checks.



TERMS AND CONDITIONS
SUBMISSIONS
In the event that you submit to A PERSONAL EXPRESSION as part of your order, any materials including, without limitation, photographs and other images, text, graphics, data, and other materials (collectively, “Submissions”), you will retain ownership of such Submissions, and you hereby grant us and our designees a worldwide, non-exclusive, sublicenseable (through multiple tiers), assignable, royalty-free, fully paid-up, perpetual, irrevocable right to use, reproduce, distribute (through multiple tiers), create derivative works of, and publicly display and perform such Submissions, solely in connection with the Service. Except for the foregoing license, we do not claim ownership of any copyright in your Submissions. You represent, warrant and covenant that you own or otherwise possess all necessary rights with respect to your Submissions, and that your Submissions do not and will not infringe, misappropriate, use or disclose without authorization, or otherwise violate any intellectual property or proprietary right of any third party, and are not unlawful, fraudulent, threatening, abusive, libelous, defamatory, obscene or otherwise objectionable.

None of the Submissions will be subject to any obligation, whether of confidentiality, attribution or otherwise, on our part and we will not be liable for any use or disclosure of any Submissions. You acknowledge and agree that we may (but are not obligated to) do any or all of the following, at our discretion: (a) monitor and/or filter any Submissions (including without limitation by means of blocking or replacing expletives or other language that may be deemed harmful or offensive); (b) alter, remove, or refuse to produce any Submission (including, without limitation, by suspending the processing and shipping of any order relating to any Submission); and/or (c) disclose any Submissions, and the circumstances surrounding the transmission or use thereof, to any third party in order to produce the photo products; to protect our affiliates, distributors, partners, licensors, advertisers, sponsors, and users; to comply with legal obligations or governmental requests; to enforce these Terms; or for any other reason or purpose.

We recommend you keep back-up copies of your Submissions in case of unexpected loss or damage during creation and/or shipment of your order.

INDEMNIFICATION
You agree to indemnify, defend and hold us, our affiliates, distributors, partners, licensors, advertisers and sponsors, and our and their directors, officers, employees, consultants, agents and other representatives, harmless from and against any and all claims, damages, losses, costs (including reasonable attorneys’ fees) and other expenses that arise directly or indirectly out of or from (a) your breach of these Terms, including any violation of the rules set forth in the Sections above.

RETURNS/REFUNDS
If a product is found to be defective, then you may contact A Personal Expression for a reprint or other compensation. Errors attributed to the customer as a result of their order detail submission are not subject to free reproduction/reprint. The customer may correct the issue and the reproductions/reprints of the order will be completed at a 10% discount of the regular price for each item. For reproductions/reprints, shipping will be set as ground unless otherwise specified and will be paid for by the customer. Upgrades to shipping will be available at standard rates. A Personal Expression is not responsible for damages incurred during the shipping or handling of the products after they are transferred to the mail carrier. Disputes, regarding the state of packages upon arrival, should be addressed directly to the carrier.

Errors caused by A Personal Expression will be corrected and shipped free of charge. A Personal Expression must be contacted via e-mail at service@apexpression.com or by phone at 570-275-8522 within 3 days of receiving your order. If a product is deemed defective, A Personal Expression will replace the item(s), refund the cost of the item, or credit your account towards future purchases. Monetary compensation will only be offered for the cost of product on orders found to be defective due to an A Personal Expression error. Shipping and handling charges may be compensated with store credit when applicable. Refunds will not be honored for customer errors (typos or incorrect file submission), slight color variances in printing results within four color (CMYK) industry standards for pleasing color and undeliverable packages (3rd delivery attempts and orders returned without an RMA – Returned Merchandise Approval).

By using the service provided by A Personal Expression, you agree that you will not attempt to undermine the integrity of this web site.

BY PLACING AN ORDER YOU INDICATE ACCEPTANCE OF THESE TERMS, YOU ACKNOWLEDGE THAT (1) YOU HAVE READ AND REVIEWED THESE TERMS IN THEIR ENTIRETY, (2) YOU AGREE TO THESE TERMS, AND (3) THESE TERMS CONSTITUTE BINDING AND ENFORCEABLE OBLIGATIONS OF YOU.
